Terms, Conditions & Regulations For Auction
In order to secure a bidder number you must give us your current address, have a valid photo identification card and you will be required to place your right thumbprint on Our Registration Card and sign a copy of this document as well as a "LIABILITY RELEASE." The Liability Release is after the terms and conditions below.
1. All items are sold as is, where is without any guarantee or any warranty whatever unless specifically made on an individual item. This means YOU GET WHAT YOU SEE! IF PARTS ARE MISSING, WE WILL NOT BE ABLE TO SUPPLY THE PARTS.
2. All Accounts must be settled before leaving the auction property. We accept cash, traveler’s checks, certified funds, and checks only with a bank letter of guarantee and personal checks only from buyers known to us. All returned checks will be prosecuted according to North Carolina General Statute Section 6-213. IF YOU HAVE TO LEAVE TO GET A TRUCK – PAY YOUR BILL BEFORE YOU LEAVE! IF WE HAVE TO WAIT ON YOU TO RETURN PAST A REASONABLE TIME, WE MAY CHARGE YOU FOR THE TIME.
3. A 10% buyer’s premium is added to all sales. Sales tax will be added if applicable.
4. Once any item is called “sold”, it is the sole responsibility of the buyer to possess and protect the item. We will not accept any responsibility for protecting any item after it is sold. We will still charge you for any misplaced items that you buy. YOU MUST PROTECT YOUR PURCHASES. WE CAN NOT PROTECT YOUR PURCHASES. Title to any item shall pass only when valid payment is made to our cashier. NO ITEM MAY BE REMOVED FROM THE PROPERTY WITHOUT A PAID RECEIPT. NO EXCEPTIONS. Anyone caught taking items that are not theirs will be subject to arrest.
5. We reserve the right to add to or delete from any list of items advertised either in publications or in our own mailing pieces. We accept absolutely no responsibility for incorrect descriptions, errors or omissions either made in advertisements or given verbally by any staff member or the auctioneer. All information is from sources deemed reliable but is not guaranteed.
6. We do accept absentee bids. Absentee bids are in effect opening bids as the absentee bidder gets only one opportunity to bid on an item. Items that have an absentee bid left will be so identified prior to offering an item at auction. Absentee bids placed by buyers not known to us must be accompanied by certified funds or cash equal to the absentee bid including buyer’s premium and sales tax when applicable.
7. The auctioneer reserves the right to refuse any bid as well as determine and regulate the increase of the increments in the bidding. The auctioneer reserves the right to bid on behalf of the seller on any items with a reserve price as specified in 21 NCAC 4B .0605 BIDDING.
8. There is no such phenomenon as a “tie bid”. If two bidders are at the same bid amount, the item will be placed up for bidding again and everyone present will be allowed to bid even though they may not have bid on that item previously.
9. The auctioneer reserves the right to settle any dispute that may occur. The auctioneer’s decision is final and will prevail.
10. The clerk’s record and the recorded tape of the auction will prevail in any dispute on the selling price of any item.
11. When you check out, be sure that every item you purchased is listed on your invoice. For as long as we have been in the auction business, we have tried to figure out how every buyer knows immediately if we make a mistake and charge them for something that they did not buy but it is an extremely rare occasion when someone tells us that we failed to charge them for something that they did buy. Please check out only once at any one auction.
12. The auction company reserves the right to refuse admittance to and or remove any person from the property who causes a disturbance or becomes a nuisance as well as to remove any person without reason or explanation.
13. If the address you gave the cashier when you registered is incorrect, please see the cashier and get it corrected immediately. If we have mail returned because you gave an incorrect or incomplete address we will immediately remove your name from our mailing system and you will not be allowed to bid at any further auction until we have a correct and complete address.
14. Any buyer who leaves and knowingly and intentionally does not pay for their purchases will be subject to arrest and will be charged 15% per day (minimum $15.00 per day) each day until their purchase account is settled.
15. All items purchased must be removed the day of the auction unless arrangements are made with the owner. Any buyer who leaves their purchases here does so at his own risk. The auctioneers and the owner of the property accept no responsibility for protection of items left on the property.
16. We allow everyone who works for or with us to bid and make purchases at any auction. After all, they have green money too!
17. The owner and/or the auctioneer will immediately (or fairly quickly) make a decision on anything not covered in this list.
18. All persons attending the preview(s) and the auction and/or all persons removing goods purchased assume all risks of damage or of loss to person and property and specifically releases the auctioneer and seller from all liability thereof. Neither the auctioneer nor his principal shall be held liable for any defect in or condition of the premises on which the auction is held.
19. We can not provide labor to load your purchases. We do not have tools to lend you. We expect you to protect your purchases. Do not complain about the condition of an item after you bought it. You bid on the item in the condition that it existed in prior to winning the bid. ALL SALES ARE FINAL - NO RETURNS – NO REFUNDS.
20. All announcements at auction take place over any and all printed information and all information on any Internet sites.
We welcome you to our auction and we appreciate your being here. By registering for and accepting a buyers number, you have entered into a legally binding contract with us, enforceable at law, that you will abide by and be bound by the above terms and conditions of the auction. If you find that you do not or can not agree to this implied and legally binding contract, please return your buyer card to the cashier and do not participate in our auction. Please return your bidder card to the cashier before leaving the auction site. You could be responsible for items bought on your number by another person. Protect your buyer number card.

Liability Release And Hold Harmless Agreement
The undersigned hereby releases building owner of record at 920 D Black Satchel Drive, Charlotte NC 28216, their officers, successors, agents, assigns, heirs and employees, West Charlotte Transfer & Storage Inc., dba/ Charlotte Metro Moving & Storage, their officers, successors, agents, assigns, heirs and employees, and American Auction Associates, Inc. of charlotte, Charlotte North Carolina and their officers, successors, agents, assigns, heirs and employees from any and all liability arising out of and as a result of entrance to the property named above and/or attendance at auction or preview on property named above on Saturday, July 22, 2006 and at any further times as a result of entering said property and moving or removing any purchased items from said property at 920 D Black Satchel Drive, Charlotte NC 28216. The undersigned further releases all parties connected from any and all liability arising out of any and all actions and occurrences and from any and all harm, loss or injury that may be caused as a result of any errors caused by any party connected with this auction and from any and all liability as a result of any and all accidents as well as any and all other claims of any liability from any loss or harm arising out of removing, assembling, loading and transportation of items purchased at said auction. By accepting a bidder card, the undersigned further agrees to abide by all terms and conditions as printed and made available from the person registering the bidders at said auction. I agree to hold harmless above named parties from any loss, harm and all liability as specified above and I will be completely responsible and liable for my allowing any members of my family, associates, friends or any other persons with me as if they were in fact the same as myself or acting on my behalf, that I allow to enter the property as a result of my attending and registering for a bidders number at said auction. I further agree that I will be completely responsible for any damage to the building or property that may occur as a result of the removal of items purchased, assembly of items purchased, loading of and transportation of any items purchased by me, my employees, agents or family. I understand that all purchases must be removed no later than 5 PM on Saturday, July 22, 2006. I further understand and agree that any item that I purchase and leave on the said property for later removal is left at my sole responsibility. I further release all parties connected with the auction company and the seller from all liability and responsibility for the protection and loss prevention for any and all items I have purchased and left for later removal. I have read and I understand this Liability and Hold Harmless Agreement. I have signed below on this date as indicated above in Charlotte, North Carolina, County of Mecklenburg.
